1. Acceptance of Terms
By downloading, installing, or using StatsCalm, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not install or use the application.
2. License Grant & Permitted Use
DamilanTech grants you a non-exclusive, non-transferable, revocable license to download, install, and use StatsCalm on Mac devices associated with your Apple Account in accordance with the Apple Media Services Terms and Conditions.
You agree not to reverse engineer, decompile, disassemble, modify, create derivative works of, or distribute the application without prior written authorization from DamilanTech.
3. Purchases, Pricing & No Subscriptions
StatsCalm is offered via the Mac App Store under a Lifetime Purchase (In-App Purchase / One-Time Payment). There are no recurring subscription fees.
All payments, refunds, taxes, and transaction handling are executed exclusively through Apple StoreKit. Refund requests must be directed to Apple Support in accordance with Apple's refund policies.
4. Diagnostic Telemetry Disclaimer
StatsCalm provides hardware monitoring indicators, S.M.A.R.T. disk health estimates, power draw calculations, and thermal warnings derived from Apple system frameworks (IOKit, DiskArbitration, CoreWLAN). These readings are intended for informational, diagnostic, and monitoring purposes only.
StatsCalm is an advisory tool and does not replace regular drive backups (such as Time Machine). You remain solely responsible for backing up your data and taking appropriate precautions with your hardware storage devices.
5. Intellectual Property
All title, ownership rights, trademarks, logos, and intellectual property rights in and to StatsCalm are owned exclusively by DamilanTech. Apple, macOS, and Mac App Store are trademarks of Apple Inc.
6. Disclaimer of Warranties
StatsCalm is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall DamilanTech be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or hardware malfunction resulting from the use of the app.
8. Apple Standard EULA Integration
In addition to these terms, your use of the application is subject to Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA).
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of your applicable jurisdiction, without giving effect to any principles of conflicts of law.
